WAVIER: In consideration for my utilization of the programs, services, facilities, and equipment available prior to or during the Milestones Running Club, LLC program, I voluntarily agree to assume all risks involved with my participation in the Milestones Running Club, LLC program or classes. I voluntarily agree to assume all risks, including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being relieved, from dangerous or defective equipment or property owner, maintained or controlled by them, or because of their possible liability without fault.

I WAIVE, RELEASE AND DISCHARGE from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons release, for death, disability, personal injury, property damage, property theft, as a result of weather conditions, or actions of any kind which may hereafter occur to myself including my travel to and from this program, the following entities or persons, and/or their directors, officers, employees, coaches, agents, staff, representatives, event sponsors and event volunteers: Milestones Running Club, LLC.

I understand that I will be exposed to the risk of injuries (both temporary and permanent). I also recognize that there are both foreseeable and unforeseeable risks of injury or death that may occur as a result of my participation in the use of programs, services, facilities and equipment of the Organizer-Affiliated Entities that cannot be specifically listed. Further, I recognize that the actions of other users may cause harm or loss to my person or property.

I am ACCEPTING this assumption or risk and release or liability on my own behalf shall be bound by the terms of this assumption of risk and release of liability.

In the case of emergency where my emergency contact cannot be reached, I hereby give authorization to the Organizer-Affiliated Entities, its employees and the treating physician to obtain or provide medical treatment deemed necessary for the immediate welfare of myself.

I have carefully read this assumption of risk and release of liability and fully understand its contents. I am aware that this assumption of risk and release of liability is a contract between the Affiliated Entities and myself. I ACCEPT it of my own free will.

ILLNESS/COVID 19: By registering for and ACCEPTING this document, I agree that I will not attend our running session if anyone in our household has been experiencing any of the following symptoms:

• Temperature at or above 100.4 degrees Fahrenheit
• Persistent, dry cough, shortness of breath or difficulty breathing not related to asthma or other chronic respiratory condition.
• Chills, repeated shaking with chills, muscle pain or headache, sore throat, new loss of taste or smell
• Diarrhea, abdominal cramps
• Nausea and vomiting

If I have been diagnosed with COVID-19 or the flu, I will wait 10 days before returning to the program.

COVID-19, the flu, and other viruses are contagious and transmitted from person to person. I understand that my participation in activities with other people could increase their risk of contracting viruses. I understand that participating in Milestones Running Club, LLC is a personal decision and completely voluntary and not required.

I understand that Milestones Running Club, LLC program will take place primarily outdoors and that masks will not be required by club leaders. Milestones Running Club, LLC is not responsible for enforcing the use of personal protection equipment.

PRIVACY: I consent to Milestones Running Club, LLC the use of any photographs or video recording that are taken of myself while participating in the activity for use in Running Club company websites and program materials that are distributed both as printed document and on the internet. No payment will be made for use of these photographs and/or videos.

REFUNDS: Refunds will not be issued for cancellations or withdrawals.

WEATHER (Applicable to our PARK programs): We will attempt to run in all conditions, excluding thunder and lightening. If prior to class the weather forecast looks that a storm is certain, we will reach out to all parents via text with as much notice as possible for cancellation. If a storm pops up after class has started, we will seek shelter if the weather radar indicates that there is lightning closer than 8- 10 miles away.

BEHAVIOR: Milestones Running Club, LLC reserves the right to release, without refund of program fees, any child whose behavior becomes unmanageable.

CONSENT:

I am aware that this assumption of risk and release of liability is a contract between the Affiliated Entities and myself, as named below. By completing and submitting this form, I accept all terms set forth in this document, including waivers and program policies.
