WAVIER: In consideration for myself and my Minor Child (or Children) being allowed to utilize the programs, services, facilities, and equipment available prior to or during the Milestones Running Club, LLC program, I voluntarily agree to assume all risks involved with myself and my Minor Child (or Children) participating in the Milestones Running Club, LLC program. I voluntarily agree to assume all risks, including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being relieved, from dangerous or defective equipment or property owner, maintained or controlled by them, or because of their possible liability without fault.

I WAIVE, RELEASE AND DISCHARGE from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons release, for death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to myself or my Minor Child (or Children) including mine and my Minor Child’s (or Children) travel to and from this program, the following entities or persons, and/or their directors, officers, employees, coaches, agents, staff, representatives, event sponsors and event volunteers: Milestones Running Club, LLC.

I understand that myself and my Minor Child (or Children) is exposed to the risk of injuries (both temporary and permanent). I also recognize that there are both foreseeable and unforeseeable risks of injury or death that may occur as a result of my and my Minor Child’s participation in the use of programs, services, facilities and equipment of the Organizer-Affiliated Entities that cannot be specifically listed. Further, I recognize that the actions of other users may cause harm or loss to myself or my Minor Child’s (or Children) person or property.

By ACCEPTING as the parent or guardian of the Minor Child (or Children), I represent that I am the legal parent or guardian of the Minor Child (or Children). I, the undersigned parent or legal guardian, acknowledge that I am also ACCEPTING this assumption of risk and release of liability on behalf of myself and the Minor Child (or Children) and that myself and the Minor Child (or Children) shall be bound by the terms of this assumption of risk and release of liability.

In the case of emergency where I cannot be reached, I hereby give authorization to the Organizer-Affiliated Entities, its employees and the treating physician to obtain or provide medical treatment deemed necessary for the immediate welfare of myself and my Minor Child (or Children).

I have carefully read this assumption of risk and release of liability and fully understand its contents. I am aware that this assumption of risk and release of liability is a contract between the Affiliated Entities and myself and on behalf of myself and my Minor Child (or Children). I ACCEPT it of my own free will.

ILLNESS/FLU/COVID 19: By registering my Minor Child (or Children) and ACCEPTING this document, I agree that for myself and my Minor Child (or Children), we will not attend our running session if anyone in our household has been experiencing any of the following symptoms:

-Temperature at or above 100 degrees Fahrenheit

-Persistent, dry cough, shortness of breath or difficulty breathing not related to asthma or other chronic respiratory condition.

-Chills, repeated shaking with chills, muscle pain or headache, sore throat, new loss of taste or smell

-Diarrhea, abdominal cramps

-Nausea and vomiting

If my myself or my Minor Child (or Children) has been diagnosed with COVID-19, I/he or she will wait 7 days before returning.

The flu and COVID-19 are contagious viruses that are transmitted from person to person. I understand that my and my Minor Child (or Children) participating in activities with other people could increase their risk of contracting viruses. I understand that participating in Milestones Running Club, LLC is a personal decision and completely voluntary and not required.

I understand that Milestones Running Club, LLC program will take place outdoors and that masks will not be required by club leaders. I acknowledge that it is my responsibility to ensure that my own children follow the guidelines I set forth for them regarding masks, social distancing, and other practices. Milestones Running Club, LLC is not responsible for enforcing the preferences I set forth for my children regarding the aforementioned.

PRIVACY: I consent the Milestones Running Club, LLC to use of any photographs or video recording that are taken of myself and my Minor Child (or Children) while participating in the activity for use in Run Club company websites and program materials that are distributed both as printed document and on the internet. No payment will be made for use of these photographs and/or videos.

REFUNDS: Refunds will not be issued for cancellations or withdrawals.

WEATHER: We will attempt to run in all conditions, excluding thunder and lightening- however if the weather seems extreme we will reach out to all parents via text with as much notice as possible for cancellation.

BEHAVIOR: Milestones Running Club, LLC reserves the right to release, without refund of program fees, any participant whose behavior becomes unmanageable.
